We are officially registered Association "Nova Stara planina", which represents an informal citizens' movement "Odbranimo reke Stare Planine (Balkan Mountains)", with more than 90.000 members of a Facebook group Defend the Rivers of Stara Planina (Balkan Mountains)" 

It is important to mention that, although we use term "shop" on our website, we don't sell any products, or issue fiscal bills for the same. Every financial transaction on the website, including the ones from the section named "Shop" is considered to be your donation, i.e. a donation of a member of our Association, from legal and administrative point of view. Displayed products actually represent our gifts for your donations.

Every product has its purchase value, which is usually 50% of the amount displayed next to the product. We mention this so that you can have a rough idea about which part of that amount is used to support our actioins.

Which Personal Data Do We Collect and Why

Comments

When visitors leave their comments, we collect the data from the comment template, visitor's IP address and the user agent string of visitor's web browser, to help us discover undesirable and inappropriate content.

Anonymized string of your e-mail address (also called hash) can be sent to Gravatar service to determine whether you actually use that e-mail address. Privacy policy of Gravatar service is available at https://automattic.com/privacy/. Once your comment has been approved, your profile picture is visible to the public in the context of your comment.

Content

If you're uploading photos to a web location, you should avoid uploading photos with embedded location info (EXIF GPS). Visitors of that web location can pull your location info from that picture after they download it.

This website is created on a WordPress platform, but it also has integrated the following services: Google Site Kit, Hubspot (free Hubspot CRM), Super Socializer, WooCommerce and Facebook Pixel. The amount and type of data these services collect, depend solely on their privacy policies and laws of the states they operate from. Once you register as our member, we plan to use them in the next stage of website development, to help us deliver the information about events we organize with a goal to defend the rivers of Balkan Mountains.

How Long Do We Keep Your Data

If you leave a comment, that comment and its metadata are kept indefinitely. This makes us easier to recognize and automatically approve all the comments that follow, instead of holding them in a queue.

We also keep personal information users who register on our website provide during registration. Users can see, edit or delete their personal data at any time (except changing their user name). Website admins can see and edit this information.

Your Rights in Regards to Your Data

If you have an account on this website or if you have left comment(s), you can request to receive a file with exported personal data we have about you, including any data you have submitted. You can also request that we delete all the personal data we have recorded about you. That doesn't include any data we have to keep from administrative, legal or security reasons.

How Do We Protect Your Data

Apart from the fact that only a limited number of people has access to the data you submit, we use SSL certificates and Cloudfare for the protection of the traffic exchanged over our website. We're currently in a procedure of application for Cloudfare's Galileo project, which will introduce an additional level of protection, from DDoS attacks. Once we're granted participation in Galileo project, we'll update this section with this information.

Which Measures do We Conduct in Case of Data Leakage

If data leakage happens, we will immediately notify all our members and conduct all the legal actions.

From Which Third Parties Do We Receive Data

We're not aware of any as of now.

Which Automated Decision Making and/or Profiling Do We Do With User Data

We will use the possibilities of Facebook Audience Manager to select target audience which visited the website when creating Facebook ads.

Requests to Disclose Regulated Industries

As per the information we have, this is not applicable to us.

A list of plugins below also contains their regular information about privacy policy, which they provide during the installation. Kindly consider understanding any terms defined as "purchase" in the policy as a "donate for a gift".

Data Confidentiality

User's personal and address data, submitted to the Association during donating for a gift, are considered as a trade secret.

Association is not allowed to sell, order, provide or exchange user's personal name or credit card info to the third party in any shape, unless that third party is a Bank or state authoritiesi. If the Association intends to send promo material to its users, using their personal data obtained during e-commerce transaction, it must notify its members in advance and offer them a possibility to deny participation in a marketing campaign by interaction on the e-commerce sales location.

Association commits not to request from its user, or archive in any shape, any data connected to the card used for payment, especially card number, expiration date, CVC2 and CVV number, etc.

We collect information about you during confirmation of the donation for which we give a gift from the store.

We monitor the following while you're visiting the store:

  • Recently viewed products: we use this to show you previously seen products,
  • Location, IP address and browser used: we use this information to estimate tax and shipping costs,
  • Delivery address: we will ask you for this info to be able to estimate, for example, shipping and handling costs before you place your order and before we send you the order confirmation.

We also use cookies to track the content of your cart while you're browsing our website.

Once you buy (donate), we will require some information from you, including: your full name, billing address, shipping address, e-mail address, phone number, credit card info and possibly your account info, i.e. your username and password. We can use this data to:

  • Send you the information about your account and your order,
  • Answer your queries, including refunds and complaints,
  • Payment processing and fraud prevention,
  • Set your account for our store
  • Comply with all the legal obligations we have, like tax calculations,
  • Improve our store offer,
  • Send you ads if you opt to receive them.

If you make an account, we will store your full name, address, e-mail address and phone number, so that we can quickly fill in the purchase confirmation for future orders.

In general, we store your info for as long as we need to store it for the purpose why we store and use it. For example, we need to store your order info for required amount of years to comply with tax and accounting needs. This applies to your name, e-mail address, billing and delivery addresses.

We will also store comments and reviews if you select to leave them.

Our team members have access to the information you select to leave. For example, our administrators and store managers can access the following:

  • Order information, i.e. what was purchased, when it was purchased and where it needs to be sent, and
  • Buyer info, i.e. full name, e-mail address and shipping and billing addresses.

Our team members have access to this info to help processing the orders, processing the refund requests and provide customer support.

We accept PayPal transactions. During transaction processing, some of your info is sent to PayPal, including information needed for payment processing or support, like total amount of the donation and information about the invoice.

Term "Donation" in the Republic of Serbia's Legislative and Difference Between Sponsorship and Donation

Donation is given without any fees and counter-services, and can be realized in money, goods or services. On the other side, sponsorship represents giving money or goods and receiving some service in return.

Donation can be made in money or goods (buildings, mobile things, stocks, merchandise, materials, receivables, etc.), without limitations in value.

For a donor, donation represents the expense which, legally, can be subject of a tax relief, but not necessarily. If a donor is tax obligor, VAT must be calculated based on the purchase value or market value of the donation (in case of long-lasting property, tax base is the unamortized cost).

Money donations are not subject to VAT. On the other side, receiver of the donation sees this donation as an income, which means that if receiver is a tax obligor, value of the donation increases receivers tax obligation. Donation doesn't need to be proven by any contracts or written requests, but needs to be proven by a genuine donation evidence, which could be, for example, a bank account statement containing the received amount, or cost accounting for the donation with a proper explanation.

Sponsorship applies to giving money or any other property, with mandatory counter-service. This is why a sponsorship contract needs to be signed, which regulates the relations between the contracting parties. In this case, receiver of the sponsorship is obliged to issue an invoice for the preformed counter-service. Following expenditures (in the total amount of not more than 5% of the total Income) are recognized as Expenses in the obligor's tax balance: 1) Expenditures for health, educational, scientific, humanitarian, religious and sports purposes, environment protection, as well as givings to the institutions providing social care, founded in accordance with the corresponding social care laws; 2) humanitarian aid, that is removing consequences of the emergency situation, when Republic, Autonomous Province or Local Self-Government. Expenditures from Paragraph 1. Point 1) of this Article are recognized as Expense only if they've been sent to the entities registered, or founded with this purpose, in accordance with special regulations, which use the provided resources exclusively for the purposes from Paragraph 1. Point 1) of this Article. Expenditures for investments in area of culture, including cinematography, are recognized as Expense in the amount of not more than 5% of the total Income. Membership fees in Chambers, Unions and Associations are recognized as Expenses in obligor's tax balance not more than 0,1% of the total Income.

Membership fees, the value of which is enforced by law, are recognized as Expenses in the amount prescribed by the law. Representation expenditures are recognized as Expenses up to 0.5% of the total Income.

Protection of the Confidential Data About Transactions

Our website uses SSL certificates, Cloudfare protection (business edition) from DDoS attacks. It also uses PayPal and Banca Intesa (Serbia) payment gateways, which have their own data protection standards, which we fulfill, so that you can safely perform transactions on our website.

Refund Policy

We are not an online store and we don't perform any sales. As a non-profit citizens' association, we collect donations to help us fulfill our goals. Any person which completes a registration form on our website automatically becomes a registered member of our Association. Wherever the term "store" is used on our website, it actually refers to a donation, for which we send you a gift. Please note, since you donate and get a gift for it, the gift itself cannot be replaced. Taking into account that the gift value is mostly 50% or more of the value of donation, every change of the gift would annulate your donation, so the Association's board of directors has decided not to allow any changes of the gift, unless you pay the difference to the amount of the newly selected gift.

In case of return of the gift and a refund to the donor, who previously used payment card for the transaction (partially or in whole), novastaraplanina.com is obliged to refund the donated amount exclusively via VISA, EC/MC and Maestro payment methods, meaning that the bank will refund the needed amount on the donor's card as per Association's request.

Complaints

It is very important that every complaint about the gift, its quality and overall state, is immediately forwarded to [email protected] We have obliged our partners that any damage on the gift should be compensated based on the agreement on business and technical cooperation between the Association and the partner.

Also, if you wish to make a correction on the donation amount, you should contact us at [email protected], with the donation number, type of change you want to perform and in which amount. After that, the Association will perform the refund or change the if possible.

Important to mention, once the status of the donation is set to "Completed", your gifts are ready and shipped and your donation has been booked and any further corrections are not possible anymore.

Statement on the Conversion

Every payment is completed in the currency selected on the website and in accordance with the rules of payment gateway.

PayPal payments can be executed only in EUR and other currencies supported by PayPal. If price on the website is in RSD, PayPal will charge the corresponding EUR amount, after the conversion, with a rate of 117,5 RSD for 1 EUR. The Association holds its right to modify this conversion ratio without the advance notice. Also, the Association holds no responsibility and can't impact any further conversions between PayPal and your bank or card provider.

Payments through the Banca Intesa payment gateway – all payments will be executed in RSD. Your credit card will be charged with the amount calculated after the EUR-RSD conversion, according to the official exchange rate of the National Bank of Serbia. This amount can be further converted to your local currency, according to the exchange rate of the Association of Credit Card Issuers. Due to this conversion step, there is a possibility that the final amount will slightly differ from the donation amount stated on our website.

Delivery of the Goods

The Association denies any responsibility for the gift delivery and any potential damage which can happen during the delivery. However, as an Association, we do have an agreement on the business cooperation with courier companies, where it is explicitly stated that if any damage occurs during transport, the Association will, within its capabilities, force the courier company to compensate the same or send the gift again. The Association holds no financial responsibility towards its members for the donations with gifts, if the gift doesn't look the same as expected, but has obliged all the authors to provide as credible pictures and descriptions of their products, as possible. We kindly ask all the members to report any issues during gift delivery, so that we can act accordingly and sanction any activity which damages the reputation of our Association.
